According to reports, the president signed the bill "On Supplementary Modifications to Certain Legal Provisions of the Republic of Kazakhstan on Issues of Protecting Women's Rights and Children's Safety" and "On Adding and Revising Parts of the Code of Administrative Offenses of the Republic of Kazakhstan concerning Issues of Protecting Women's Rights and Children's Safety" Contents of the Act.
It is worth mentioning that President Tokayev proposed increasing penalties for domestic violence in his State of the Union addresses delivered on March 16, 2022 and September 1, 2023.
The amendment aroused heated discussion in society. Members of the National Kurultai, non-governmental organizations, the Presidential National Council for Women's Affairs and Family Population Policy, and the National Center for Human Rights participated in the drafting of the bill.
According to previous reports, the Kazakhstan Senate (the upper house of parliament) officially approved the two bills on April 11.
According to the above two legal amendments, if the suspect intentionally commits violent acts against family members or children and causes minor harm to the physical health of the other party (or any level of injury above minor), or commits acts such as inciting suicide against family members or children , will be held criminally responsible. Those who commit bullying, cyberbullying, or force children to leave public transportation will be subject to double administrative liability. While pursuing criminal or administrative liability, the court has the power to impose appropriate restrictive measures on the offenders who violate the above content.
It is worth mentioning that the bill specifically stipulates that murder, sexual assault, or other sexually violent crimes against young children will be punished by life imprisonment.
Kazakhstan’s State Advisor Erlan Kalin previously posted that Kazakhstan will protect the basic rights of women and children as one of its national policy priorities. He emphasized that the head of state always attaches great importance to this issue.
He also said that at the Third National Kurultai Congress, President Tokayev listed domestic violence as one of the social evils that must be resolutely eradicated.
